Comprehensive mediation, the sensible alternative to litigation
What is Mediation?
- Mediation is a voluntary process in which a neutral third
party (the mediator) helps the parties work towards a mutually
acceptable solution to their dispute
- Mediation works because it shifts the focus from areas
of disagreement to areas of mutual concern
- Mediation provides a process in which various solutions
are suggested and explored in a climate of co-coperation
Why Mediation?
- Many people do not want to embark on litigation or negotiations
which they feel will escalate the conflict and make resolution
more difficult;
- Some people want to discuss 'non legal' issues, which
would not normally form part of legal negotiations;
- Many people want to explore creative solutins to their
problems and arrie at a custom-made agreement which suits
their particular situation.
How does Mediation work?
The parties meet together with the mediator, who guides
the process so that everyone has a chance to be heard. Various
solutions ay be explored and alternatives suggested. The
parties then select the best solutions to be incorporated
into an agreement. The mediator prepares a memorandum of
agreement and the parties are referred to their own lawyers
for independant legal advice before signing and agreement
and also to carry out the terms of an agreement.
